The New Jersey Election Law Enforcement Commission will have a special telephonic meeting at 11:00 a.m. on Thursday, November 29, 2007, at the Commission’s office at 28 West State Street, 12^th Floor, Trenton, New Jersey. This special meeting is being held pursuant to N.J.S.A. 10:4-9 and is necessary to deal with an urgent matter of importance and of concern to the public interest about the application of the pay-to-play laws to nonprofit entities. A delay for the purpose of providing adequate notice might result in harm to the public interest. The Commission could not have foreseen the need for this meeting at a time when adequate notice could have been provided. The special meeting will be limited to discussion of the matter of importance.

The Agenda is as follows*:

1. Open Public Meetings Statement.
2. Discussion of application of the pay-to-play laws to nonprofit entities in light of proposed legislation to amend such laws. The Commission has received a request from Leon Sokol, Esq., representing the New Jersey Senate, informing the Commission that legislation to amend the pay-to-play statutes in order to exempt not-for-profit entities has been prepared for introduction and consideration when both Houses of the Legislature convene in December. Mr. Sokol respectfully requests that the Commission delay the filing deadline of November 30, 2007 applicable to non-profit entities and their officers and directors, to January 15, 2008, the date of a scheduled Commission meeting, in order to give the Legislature sufficient time to consider such legislation.
3. Public Comments – The Chair will ask for public comments at appropriate times during the meeting.

Pursuant to the New Jersey Fair and Clean Elections Act (P.L.2007, c.60), certified Clean Elections candidates must participate in two general election debates as a condition of receipt of public funds. Noncertified candidates may elect to participate in the debates.

The New Jersey Election Law Enforcement Commission today temporarily suspended the pay-to-play filing deadline for nonprofit business entities only.

Citing a pending opinion from the Office of the Attorney General as to whether or not nonprofit business entities should be subject to pay-to-play disclosure requirements, the Commission acted to suspend the deadline until October 30, 2007. The Commission took this action under its authority to relax its rules.

The Commission will review the issue at its next meeting on October 23, 2007.

For-profit business entities are still required to file the annual disclosure statement on September 28, 2007.

5. Advisory Opinion Request No. 01-2007 - The Commission will discuss a request for an advisory opinion received from Ms. Patricia Hero, a 2006 general election candidate in Linden (Union County). Ms. Hero has asked whether or not she may use candidate committee funds to pay the costs of medical care she received as a result of an injury sustained while campaigning.
6. Advisory Opinion Request No. 02-2007 - The Commission will discuss a request for an advisory opinion received from New Jersey Organization for a Better State (NEW JOBS), a continuing political committee, and Cooper, Levenson, April, Niedelman, Wagenheim, P.A., a law firm. The inquiry concerns application of recently-enacted pay-to-play annual disclosure requirements, N.J.S.A. 19:44A-20.27 and N.J.A.C. 19:25-26, to the continuing political committee and the law firm.
7. 2007 Clean Elections Program Report - The Commission will review steps taken since the May 15^th meeting to implement the 2007 Fair and Clean Elections Pilot Project (P.L.2007, c.60).

The New Jersey Election Law Enforcement Commission will have a special telephonic meeting at 9:00 a.m.‚ on Friday‚ March 30‚ 2007‚ at the Commission's offices at 28 West State Street‚ 12^th floor‚ in Trenton. This special meeting is being held pursuant to N.J.S.A. 10:4-9 and is necessary to deal with an urgent matter of importance and of concern to the public interest about the 2007 Clean Elections Pilot Project. A delay for the purpose of providing adequate notice might result in harm to the public interest. The Commission could not have foreseen the need for this meeting at a time when adequate notice could have been provided. The special meeting will be limited to discussion of the matter of importance. The agenda is as follows:

The Annual Reports of Lobbying Activity filed on February 15‚ 2007 with the New Jersey Election Law Enforcement Commission (ELEC) reflect the financial activities of represented entities‚ governmental affairs agents‚ and persons or groups communicating with the general public (grassroots lobbying) for calendar year 2006. Copies of the individual 2006 Annual Lobbying Reports are available on and after February 27‚ 2007. If you wish to review a copy of an Annual Lobbying Report‚ please place your request for information on a Government Records Request Form. On Thursday‚ March 8‚ 2007‚ at 10:00 a.m.‚ data summarizing the 2006 Annual Reports of Lobbying Activity‚ along with a copy of every 2006 Annual Report received through March 7^th will be available for public inspection in ELEC’s public records room. Executive Director Frederick M. Herrmann announced today that the New Jersey Election Law Enforcement Commission is proposing amendments to its rules concerning Lobbyists and Governmental Affairs Agents‚ N.J.A.C. 19:25-20‚ to clarify portions of the Legislative and Governmental Process Activities Act‚ N.J.S.A. 52:13C-18 et seq.

According to Herrmann‚ among other provisions‚ the proposed amendments:

• Clarify that the term “member” can mean an organization as well as an individual;
• Clarify lobbying terminology by adding a new definition‚ “reporting entity‚” to have the same meaning as “lobbyist”;
• Provide a definition for the “administrative proceeding” exemption from lobbying reporting requirements;
• Clarify record keeping requirements for persons who undertake communications with the general public; and‚
• Require consent to service of process from a governmental affairs agent or lobbyist who is not a resident of New Jersey‚ is not a New Jersey corporation‚ or is not authorized to do business in New Jersey.

The proposed new rules will appear in the New Jersey Register on February 20‚ 2007‚ and are currently available on the Commission's website at www.elec.state.nj.us. Copies of the Commission's proposal may also be obtained by calling the Commission at (609) 292-8700.

The Commission will conduct a hearing to elicit public comment concerning the proposal on Tuesday‚ March 20‚ 2007 at 10:15 A.M. at:
